See first item. (This is most definitely a derivative work. I shrunk down the image to 32 x 32 and modified it to be a better pixel graphic, then added sunglasses. If someone were to ask you to send the original picture and you send the new one, and their probable response is much less than inviting, it's a derivative work.)
So, if someone is reading this and thinks the image needs a license to be specified, choose whichever one applies because I'm not sure...
