Hello

I'm still pretty new to Wiki. Is this the way to leave you a message? When I signed up it said something about being able to email other users, but I haven't seen how to do that.

I'm also assuming you're the Big Cheese here, that this is your project.

uncyclopedia.org has been secured, but is not yet pointing to the correct address so let's wait a bit. I don't know about a PayPal button. Plagiarism?

I need a ruling. Could you take a look at the history for the Jesus article? La hapalo deleted some of my material, claiming it was plagiarised, but in fact it is parody. I left him/her a message, but have not heard back. What I wrote is clearly substantially different from the original [1]. Can you revert the reversion?

If the original were unrecognizable in the parody, it wouldn't be parody. Just think of some of Weird Al's material; how close it is to the original. Here are some more examples:

A lot of my humor is parody. Take a look at the 1903 page I did; it's a direct parody of the Wikipedia page. 99% of the material on this site is parody.

Oh, I most definitely think you could use, "Can't Touch This" to parody OJ Simpson. I again refer to Weird Al. Take a look through his catalog. His parody of "Mmm Mmm Mmm Mmm" isn't targeted at the original material. "Fat", "Eat It", "I Lost on Jeopardy", the same thing. The writer's guide I linked above says, "By following the style and substance of the original work, a parody may seek to ridicule, criticize or merely amuse without devaluing the original." (emphasis added)

The JibJab case was interesting. Technically it was dropped because the copyright on the original music had expired. However, even afterward, there was some discussion of whether it is in fact expired; Ludlow doesn't think it is, but dropped the case anyway. I think it was pretty clear that JibJab would have won. As Fred von Lohmann of the EFF stated, "JibJab's fantastic animation is a clear case of fair use." If JibJab had simply released the song by itself, it might have been a different case (though I personally doubt it), but I think the fact that it was contained in a much larger piece of work pushed the issue over the top. Uncyclopedia is a very large and growing body of original material.

I'm not particularly pressing for my original "Jesus" material; I want to re-write it anyway, as it's not really in the pedantic, encyclopedic style that I've been using for my other material.

But this is definitely an issue highly relevant to this project, and I think it needs to be discussed so that it's clear in everyone's minds what does and does not constitute parody. In Campbell v. Acuff-Rose Music, the US Supreme Court said, "[T]he fair use doctrine. . .requires courts to avoid rigid application of the copyright statute when, on occasion, it would stifle the very creativity which that law is designed to foster." Uncylopedia is very clearly and very emphatically a creative project. As I told La hapalo earlier today, while I am not a lawyer, I think the very fact that this entire site is a parody gives considerable latitude.

Anyway, at the very worst, if someone does get upset with material here, you're going to get a C&D letter. Then you can either C&D, which I wouldn't blame you for, or call the EFF :) --Darguz Parsilvan 14:51, 16 Mar 2005 (EST)

Misspelling engine prevention?

I've pretty much cleaned up the misspelling section of the maintenace pages. Now I face a problem. There are some misspellings that really should be there in order to make documents funny. (e.g. in mispelling) Are there a way to tag these words/lines so that the misspelling engine won't find them?

Pictures and Links

Favicon

I've made a potato favicon for the Uncyclopedia (favicons are the address bar/bookmarks icons that show up instead of the default "page" icon in Mozillio and Internet Exploder. I've tried uploading for you - assuming you want to use it - but ".ico" and ".bmp" are not recommended file formats and the upload is denied. I noticed that the page Banned from the Internet was getting a huge amount of hits, even though not many things linked to it. I think the only explanation would be that there is an outside link somewhere. I rolled back New Zealand to pre-attack to be sure. I banned 71.0.34.187 for 4 days and 202.0.37.251 for 30 days (ouch), the last I was severe with because this is the user that seems to have caused the most damage over all. Let's see, what else. I fixed the people category. Copyright and Un?

Someone made a comment to our IRC channel rather than dropping a message somewhere on the site. They claimed ... well, here's the log (with links and commentary added):

For instance, I see tons of violations of mass media copyrights here. Few successful pages lack such violations. Many pages have copyrighted images, some modified more than others, some unmodified. Copyright is a very vague and difficult subject on the internet. Usually nobody comments about it; it's understood that it may happen and there's little recourse, just hope that the offending party will be friendly about it. Considering how browsers work, the subject is obfuscated beyond reason. When is freely-provided data violating a copyright?

Our database has some corruption that seems to be spreading, which caused this unusual result. This image is used on an article. It is very weak usage, in my humble opinion, but I don't believe I should strike down any/all images used on the site based on weak usage or the fact that an anonymous person said delete it now. If that was true, we have numerous images (almost every one) that are violations, many so blatant they are happily marked as such violations. Even I have uploaded a couple blatant copyright violations and marked them as such. One has been infringed so many times that I cannot identify the original source, so I gave up. I cited the source for the other, though it is also ambiguous - I'm sure I've seen it elsewhere. This one isn't ambiguous at all, at least not on a cursory glance at the site he linked.

On further inspection, the image itself that was uploaded is too big to fall under this. With images, I usually consider any use where the source is obvious a clear violation, but that's just me, and legally this doesn't usually stand. The version on the page is different enough that it would not be considered a derivative work to my knowledge (again, I'm not a lawyer, but this is common knowledge in my professional field, which is only vaguely defined by "software developer").

This could get very demented if everyone believes they're free to tell us what to do.

So, please tell us what your executive decision is on this subject.

Notice I didn't tell you guys to delete it. I said that from my perspective as a Wikipedia denizen, this was an image which should be deleted, and left the decision up to more active and experienced Uncyc users.
